המאמר בוחן את הדיון ההלכתי על היחס הראוי בין סיכון חיילים בצד אחד לבין סיכון אזרחים בצד האחר בלחימה. הניתוח בפרק הראשון חושף מגוון דעות רחב ומחלוקות עמוקות בסוגיות רבות העומדות ביסודם של דיני הלחימה. הפרק השני מציג את מגוון הדעות בכמה שאלות ספציפיות. מעיון בשני הפרקים יחדיו עולה כי אין קשר הכרחי בין העמדות בשאלות-היסוד לבין ההכרעות בשאלות הלכה למעשה: בעלי עמדות זהות יכולים לחלוק בהכרעה, ולהפך. שני הפרקים והעיון המשלים בפרק השלישי מפריכים את הדימוי שלפיו יש הסכמה נרחבת בחברה הישראלית לגבי שאלות-היסוד, לגבי ניסוח השאלות המוסריות והמעשיות ולגבי הדרכים לפתירתן של דילמות כאלה. החיבור גם מאתגר את אופן ההצגה של עמדת ההלכה בשיח הישראלי, ומעלה תהיות על אופני ניהול השיח התרבותי, הפוליטי והמשפטי – הן מצד המדינה ומוסדותיה והן מצד הקהילות הדתיות ומנהיגיהן.

The Debate about Endangering Soldiers to Protect Innocents in Battle

Abstract
The article analyzes the Jewish legal debate regarding the endangering of soldiers in order to reduce the risk to innocent civilians in battle. In the first chapter the analysis reveals multiple attitudes and deep controversies regarding many issues that define the moral and legal discourse on Jus in Bello, or International Humanitarian Law. The second chapter introduces the multiple and varied Jewish legal opinions regarding the specific dilemma, under several conditions. I then discuss the emerging fact that there is no necessary correlation between the attitudes on the basic political philosophical questions (chapter 1) and the opinion in praxis (chapter 2). Chapter three supplements the analysis by looking at the attitude to peace, humanitarianism and violence. I also discuss the public image of the attitude of Jewish law to Jus in Bello, and the consequences of the findings in this article that refute the assumption that there is broad agreement in Israeli civil discourse about the fundamental moral and political issues, on the definition of the moral and practical questions at hand and on the ways in which to resolve these dilemmas. The article challenges the manner in which the position advocated by Jewish law is presented in Israeli discourse and raises questions regarding the cultural, political and legal debate – in the civil society, in religion-state relations and in the religious communities.
