הליכים משמעתיים מעסיקים חלק ניכר מן הציבור במדינת-ישראל הכפוף לדין משמעתי מסוגים שונים – למשל, עובדי מדינה, חיילי צה"ל, שוטרים, סוהרים, רופאים, עורכי-דין, רואי-חשבון, סטודנטים באוניברסיטות ובמכללות, ועוד. מאמר זה מבקש להתייחס לתחום מיוחד של ההליך המשמעתי – הדין המשמעתי הצבאי. במסגרת זו המאמר מבקש לבחון את שאלת זכותו של נאשם לייצוג על-ידי עורך-דין בהליכים משמעתיים בצבא, בהינתן שהליכים אלה נערכים לפני קצין שיפוט שאינו בעל הכשרה משפטית. נכון להיום הפרקטיקה הנוהגת למן הקמתו של צה"ל היא שבדין משמעתי אין לאפשר ייצוג על-ידי עורך-דין או על-ידי כל אדם אחר. המאמר מבקש להשיג על צדקתה של הפרקטיקה הנוהגת לנוכח מעמדה של הזכות לייצוג בעידן החוקתי. לשם כך המאמר עומד על חשיבותן של זכות הטיעון בכלל ושל הזכות לייצוג משפטי בפרט. בהמשכו המאמר מציג את הדין המשמעתי בכלל ובצבא בפרט, תוך בחינה של שאלת הייצוג במסגרות אלה. עיקרו של המאמר בהצגת הצורך בייצוג במסגרת הדין המשמעתי בצבא, תוך הצגת טיעונים בעד ונגד וניסיון להציע פתרון מאוזן לאורם של מבחני המידתיות.
About the Rights to Legal Representation in Disciplinary Procedures in the Military

Abstract
Disciplinary procedures have a rather deep significance for those who are subject to different varieties of disciplinary action, such as civil servants, IDF soldiers, police officers, prison guards, physicians, lawyers, accountants, students and more. This article deals with disciplinary procedure of a unique scope –Military Disciplinary Procedure and sets out to examine the accused's right to representation by a lawyer in disciplinary procedures while sentenced by a military officer who lacks any legal training. At present, representation of any kind is not allowed in military disciplinary procedures. This article wishes to oppose this practice in light of the right to representation in the constitutional era. Thus, the importance of the right to be heard, and in particular, the right to legal representation will be examined in depth. Moreover, the article will review the question of the right to representation while providing an outlook on disciplinary procedure in general and military disciplinary procedure in particular. Finally, while claiming for the need for representation in military disciplinary procedures, this article will attempt to present arguments from both sides and propose a proportional solution.
