הטיעון המרכזי של מאמר זה הוא שדיני החוזים הישראליים מתפתחים על בסיס דגם "גברי". במילה "גברי" הכוונה לכל אותם ערכים שהתרבות הפטריארכלית רואה בהם ערכים גבריים, כגון רציונליוּת, אקטיביוּת ואוטונומיה. המאמר מבסס את הטיעון באמצעות התחקות אחר השורשים ההיסטוריים והתרבותיים של היחס בין נשים לבין כסף ובין נשים לבין דיני החוזים.
נוסף על כך נבחנת השתתפותן של נשים כמתדיינות בתיקים חוזיים בבית-המשפט העליון, בהשוואה להשתתפותם של מתדיינים גברים בתיקים כאלה, ומתברר כי הפער בין מספר הנשים המתדיינות לבין מספר הגברים המתדיינים הוא משמעותי מבחינה סטטיסטית.
הבנת החוזה כתבנית גברית עשויה להבהיר מדוע נשים הודרו מהעולם החוזי, מדוע הן נכשלו כאשר ניסו להתקבל אליו, ומדוע אין די ב"ייצוג הולם" של נשים בעולם החוזי, אלא יש צורך בבנייה מחודשת של תיאוריה חוזית שאינה "גברית" ואינה "נשית", אלא אנושית.

Abstract
This article argues Israeli contract law has developed according to a "male" model. By "male" I mean all the values that patriarchal culture encodes as male values, such as rationality, active and autonomy. The article excavates the historical and cultural roots of the relationships between money and women, as well as those between contract law and women.
In addition, women’s participation as litigants in contractual cases is examined and compared to men’s participation as litigants. The gap between the number of women and men – both plaintiffs and respondents – in contract litigation proves statistically significant with twice as much men participating in contract litigation as women litigants.
The notion of the contract as a male-based concept may help clarify why women have been excluded from the world of contacts and why representation in and of itself is insufficient if the ultimate goal is a reconstruction of contract law in a way that is neither "male" nor "female," but human.
