העיסוק בדיני המיסים מבטא רגישות עמוקה באשר להגנה על זכויות האדם, ובכלל זה על זכות הקניין וזכות השוויון. לפרשנות הדינים יש עוצמה אדירה, שכן בכוחה להפוך על פיה משמעות אחת ולהחליפה באחרת, גם אם המחוקק לא ערך שום שינוי חקיקתי. בדיני המס הפרשנות היא המציירת את קו האיזון העדין שבין האינטרס הציבורי בהטלת מיסים לבין זכויותיו של הנישום. מתוך כך, מאמר זה מבקש לעמוד על טיבה וטבעה של הפרקטיקה הפרשנית הננקטת על-ידי בית-המשפט בניתוחם של דיני המיסים, ועל יחסה לזכויות האדם ולמס-אמת, שהוא בעיניי עיקרון חוקתי שנכלל בזכות החוקתית לקניין.
במאמרי זה אעמוד על ההתפתחויות שחלו בפרקטיקה הפרשנית בבית-המשפט העליון, שהתמקדו בתחילה במעבר מפרשנות מילולית לפרשנות תכליתית. אטען כי בשנים האחרונות מסתמנות כמה אינדיקציות המצביעות על חזרתה ההדרגתית של הפרשנות המילולית. לשם ביסוס טענתי זו אנתח כמה פרשות מרכזיות מן העשור האחרון, ביניהן פרשת קלס (ע"א 900/01 קלס נ' פקיד שומה תל אביב 4, פ"ד נז(3) 750 (2003)), פרשת מלכיאלי (ע"א 8114/09 מלכיאלי נ' פקיד שומה אשקלון (פורסם בנבו, 1.2.2012)) ופרשת פוליטי (ע"א 8569/06 מנהל מיסוי מקרקעין חיפה נ' פוליטי (פורסם בנבו, 28.5.2008)).
לעניות דעתי, הפרשנות המילולית שאומצה בפרשות האמורות ובפרשות אחרות אינה מאזנת באופן מידתי בין האינטרסים הציבוריים שבגביית המס לבין זכויות האדם. בפרשנות שאומצה ובגישה הפרשנית שננקטה נפגעו מס-האמת וזכויות האדם במידה העולה על הנדרש. סימני החזרה לפרשנות המילולית והצעדים הראשונים שנצעדו בכיוון האמור אינם ראויים לפיכך בעיניי. לנוכח זאת אני קורא לשקול בכובד-ראש את הנורמטיביות של החזרה לפרשנות המילולית ואת השלכותיה על זכויות האדם בעידן החוקתי. כן קורא אני לעצור את הנסיגה המילולית שמכרסמת את מס-האמת וזכויות האדם, ולחזור להגשמתם המאוזנת של הערכים האמורים באמצעות הפרשנות התכליתית בדיני המיסים.
Interpretation of Tax Law: The Role of Human Rights in the Supreme Court Jurisprudence

Abstract
Tax law plays a central role in protecting human rights and especially the rights of property and equality. The interpretation of tax law is very much important and critical in the process because interpretation can change the law without changing legislation. In tax law, interpretation draws the line between public finance and private property and rights. This article analyzes the rules of interpretation in tax law and the role of human rights in the process of interpretation.
In this article I discuss the development of the interpretation theory and practice in the Supreme Court Jurisprudence which transitioned from literal to purposive interpretation. I will argue that in recent years we can identify several signs of a return to literal interpretation, including the decisions of the court in the cases of "Keles", "Malkelli" and "Polity".
In my opinion, the adoption of literal interpretation in the aforementioned cases did not balance between human rights and taxation in accordance with the proportionality principle. I argue that the literal interpretation in these and other cases caused disproportionate infringement of human rights. I believe that this return and regression to literal interpretation is not appropriate and I call for rethinking this return and its effects on human rights in a constitutional era. I call for maintaining purposive interpretation that appropriately and proportionally balances taxation and human rights as the leading theory of interpretation in tax law.
