מאמר זה בוחן מהו הכלל הראוי להכרעה בטענת חוסר סמכות עניינית העולה בשלבים מאוחרים של ההליך המשפטי. הוא מציע כלל המאזן בין מתן תמריצים לתובעת ולנתבע להקטין את הסיכוי לטעות מראש בשאלת הסמכות העניינית לבין הקטנת העלויות הנובעות בדיעבד מטעויות כאלה כאשר הן קורות. המאמר מציע כי איזון זה ייעשה באמצעות הכלי הדוקטרינרי של בטלות יחסית.
הגישה המוצגת במאמר מסתמכת על ניתוח הפער בין האינטרס הפרטי בהגשת תביעה בבית-המשפט המוסמך לבין מטרותיו של המחוקק בקביעת כללי הסמכות. בהתבסס על אותו ניתוח המאמר בוחן גם סוגיה קרובה, והיא מידת החופש שיש לתת לצדדים להתנות על סמכותו של בית-המשפט.
The Consequences of Belated Challenges to Subject Matter Jurisdiction

Abstract
This article examines how courts should address challenges to subject matter jurisdiction, when such challenges are raised at a late stage of the litigation. It suggests that this issue should be informed by two considerations: on the one hand, belated jurisdictional challenges affect the incentives of plaintiffs and defendants to avoid and correct lack of subject matter jurisdiction; on the other hand, delayed jurisdictional challenges may result in wasted judicial and private resources. The paper advocates using the doctrinal framework of relative voidness to balance these two considerations.
The proposed approach recognizes the divergence between the private and the public interests in jurisdictional rules. Based on this divergence, the paper also examines whether parties should be allowed to contract around jurisdictional rules, in advance.
